SB
1185 (Long/Toure): Prohibits an employer from
terminating the group health insurance of any employee
because the employee has filed a workers' compensation
claim, hired an attorney for representation regarding a
claim, instituted any proceeding under the workers'
compensation act, or testified or is planning to testify in
any workers' compensation proceeding which relates to the
employee's past or present employment. The bill allows award
of attorney's fees to the prevailing party when a medical
care provider has brought a claim in the Workers'
Compensation Court. Also, employers are required to use a
prescribed form for enrollment of employees in a certified
workplace medical plan. The bill allows a child who is
receiving education at home to receive income benefits for
death until the age of 23.
