2016 Session Overview

 

The 2016 Oklahoma Legislature convened on Monday, February 1, 2016, and adjourned sine die on May 27, 2016, as required in the Oklahoma Constitution. 

The Senate welcomed Senator J.J. Dossett, who was sworn in mid-session after he was elected in a special election.  The Senate bade farewell to the class of 2004--Senators Patrick Anderson, Don Barrington, Brian Bingman, Brian Crain, John Ford, Earl Garrison, Clark Jolley, Ron Justice, Mike Mazzei, Susan Paddack and Charlie Wyrick--who were unable to run again due to term limits, and Senator Jim Halligan, who chose not to seek re-election.

While the state budget always commands much time and attention, the primary issue before the 2016 Legislature related to the shortfall of revenues in fiscal year 2016 and a downturn in the amount of revenue available for appropriation in fiscal year 2017, amounting to approximately $1.3 billion.  The Legislature enacted various revenue enhancements along with targeted budget cuts to develop a balanced budget as required in Section 23 of Article X of the Oklahoma Constitution.  Despite the shortfall and the hard choices it forced, critical funding for education and health care was preserved.

The Legislature considered 1,822 bills and joint resolutions, of which 173 Senate measures and 190 House measures became law (along with 1,724 measures carried over from the 2015 session, of which 18 Senate measures and 13 House measures became law).  Governor Mary Fallin vetoed 4 measures, along with one section of the general appropriations bill.  Another two measures referred state questions to the voters for action at the November 2016 election. 

With respect to specific issues, general appropriations for state government for fiscal year 2017 were included in SB 1616.  The Legislature also enacted legislation to refer a constitutional amendment to the voters which, if approved, will significantly change the system for selling alcoholic beverages in Oklahoma (SJR 68), along with a comprehensive rewrite of the alcoholic beverage code (SB 383).  An additional $125 million in bond funding to renovate the State Capitol was also approved (HB 3168).  Significant reform in the area of school testing (HB 3218) was also enacted with bipartisan support.

Senate leadership agenda items passed in 2016 include:

BUDGETARY and FINANCE REFORMS

  • Eliminated tax breaks and credits to generate hundreds of millions in new, recurring revenue, which will significantly reduce the reliance on one-time sources of money to pay for recurring expenses
    • SB 1577 (Pro Tem Bingman, Speaker Hickman):  capped the tax break for economically at-risk oil wells: $112 million
    • SB 1606 (Sen. Jolley, Rep. Sears):  eliminated “double-deduction” tax break: $87 million
    • SB 1604 (Sen. Jolley, Rep. Sears):  Earned Income Tax Credit made non-refundable: $25.9
    • SB 1582 (Sen. Jolley, Rep. Sears): capped Investment/New Jobs Tax Credit: $12.9 million
    • SB 1605 (Sen. Jolley, Rep. Sears):  eliminate child-care facilities tax credit: $27 million
    • SB 1614 (Sen. Jolley, Rep. Sears): reduced coal credit 25 percent: $978,000
    • SB 1579 (Sen. Jolley, Rep. Sears): enhanced use of technology for tax enforcement:  $35 million
    • HB 2775 (Sen. Smalley, Rep. McCall): income tax withholding tax reconciliation:  $4 million
    • HB 3205 (Sen. Jolley, Rep. Sears): sales tax credit statute of limitations: $8.7 million
    • SB 1603 (Sen. Jolley, Rep. Sears):  Sunsets the income tax credit that can be claimed by contractors building energy efficient homes/buildings.
    • HB 3204 (Sen. Jolley, Rep. Sears):  Reduces the railroad rehabilitation tax credit by 25 percent
  • SB 1342 (Sen. Treat, Rep. Newell): requires OMES to make modifications to the website required by the Taxpayer Transparency Act to give users the ability to track expenditures of federal funds by state agencies; provides more transparency of the budgets and spending of state agencies
  • HB 2763 (Sen. Holt, Rep. Montgomery): Creates the Energy Stabilization Fund which would receive excess revenues from the gross production tax above a five-year rolling average and could serve as a first resort when revenue failures and projected shortfalls occur.
  • SB 1030 (Sen. Mazzei, Rep. Brumbaugh):  Multi-year Revenue and Expenditure Projection Act, requires finance officials to predict revenues and expenditures three years in advance in an effort to tighten financial planning in a state that has seen a series of budget shortfalls
  • SB 1085 (Sen. Dahm, Rep. Billy): creates a check-off on income tax returns for Oklahomans to donate refunds to the General Revenue Fund

 

EDUCATION

  • Approved $51 million in supplemental funding to lessen impact of FY16 budget cuts (due to revenue failures) on students and classroom teachers
  • FY17 GA bill (SB 1616) kept common education from further budget cuts
  • FY17 GA bill (SB 1616) includes $47 million in supplemental funding for the ad valorem fund
  • Passed new curriculum standards, developed by Oklahoma experts for Oklahoma students; standards; while there may be room for improvement, these standards provide educators with certainty and allow them to focus on students and classroom learning
  • HB 3218 (Pro Tem Bingman, Speaker Hickman):  eliminates end-of-instruction exams letting teachers and students focus on classroom work; also saves districts millions of dollars and reinforces local control.
  • SB 1269 (Sen. Griffin, Rep. Casey): Develops college and career endorsements for high school diplomas that direct student coursework toward clear college and career pathways.
  • SB 1038 (Sen. Smalley, Rep. Martin): creates the Teaching Certification Scholarship Program.
  • SB 1069 (Sen. Griffin, Rep. Denney):  allows OJA to establish a charter school
  • HB 2957 (Sen. Ford, Rep. Rogers):  modifies the Teacher Leader Effectiveness Evaluation System (TLE) to create evidence-based and researched professional development plans for every Oklahoma educator.
  • HB 2720 (Sen. Jolley, Rep. Virgin): amends the Oklahoma Charter School Act to clarify how public school districts may convert an existing public school to a “conversion school,” which has the flexibility of a charter school.
  • HB 2535 (Sen. Smalley, Rep. Montgomery): Creates opportunities for schools to enter into agreements with public or private organizations for the purpose of creating apprenticeships, internships, mentorships that may fill the requirement of elective courses for juniors and seniors.
  • HB 3114 (Sen. Griffin, Rep. Martin): Empowering Teachers to Lead Act, helps enable districts to pursue a framework of teacher career paths, leadership roles and compensation requirements.
  • HB 3102 (Sen. Smalley, Rep. Caldwell):  increases the maximum number of clock hours an adjunct teacher may teach.
  • HB 2946 (Sen. Smalley, Rep. Henke): requires State Board of Education to issue a certificate to teach to persons holding an out-of-country certificate.
  • HB 3166 (Sen. Quinn, Speaker Hickman): requires additional information to be included in the State Regents’ annual report to the legislature

 

HEALTH CARE AND MENTAL HEALTH

  • FY17 GA bill (SB 1616) prevented worst-case scenario of 25 percent Medicaid provider rate cuts and provided resources to shore up rural hospitals and nursing homes
  • SB 694 (Sen. Griffin, Rep. Wright): shields from cuts Advantage program, adult day care, and programs serving developmentally disabled children and adults administered by the Department of Human Services
  • SB 1386 (Sen. David, Rep. Mulready): Allows the state to apply for an Innovation Waiver to make insurance more affordable and assist with healthcare system transformation.
  • SB 1091 (Sen. Standridge, Rep. Kannady): establishes statute of limitations on Medicaid fraud
  • SB 1149 (Sen. Griffin, Rep. Cox): allows hospitals to partners with nursing homes in another county
  • SB 1515 (Sen. Standridge, Rep. Kannady): modifies several definitions under the Oklahoma Medicaid False Claims Act and updates statutory references; raises the civil penalty from between $5,000 and $10,000 to $5,500 and $11,000.
  • HB 2962 (Sen. Griffin, Rep. Nelson): ensures insurance policies cover children with autism, providing families access to vital autism therapies and treatments their children need
  • HB 2547 (Sen. David, Rep. Mulready): Creates efficiency in healthcare by modifying telemedicine requirements.
  • HB 1697 (Sen. Griffin, Rep. Denney):  Labor Commissioner Mark Costello Act” outlines circumstances to allow judges to order individuals to participate in an assisted outpatient treatment program if petitioned by immediate family members or guardians or those directly involved with the individual’s treatment.
  • HB 2821 (Sen. Crain, Rep. Denney):  “Fred’s Law,” allows parents to build tax-sheltered savings for the long-term care of their disabled children.
  • HB 2797 (Sen. Griffin, Rep. Ann Coody):  Humanity of the Unborn Child Act, establishes a public education program for high school students to foster increased awareness of the growth and development of a baby during the nine months before birth.
  • HB 3017 (Sen. Sykes, Rep. Calvey):  protects vulnerable patients from being pressured to forego life-preserving treatment.
  • HB2820 (Sen. Bice, Rep. Denney): increases consumer access to music therapy services, and ensures music therapy treatment is provided by qualified and trained professionals.
  • HB 2267 (Sen. Justice, Rep. Cox): extends supplemental hospital offset payment program (SHOPP) fee to 2020

 

PUBLIC SAFETY AND CRIMINAL JUSTICE REFORMS

  • Criminal Justice Reforms will preserve public safety while helping control prison costs and reduce incarceration rates; the reforms will results in savings long term that can be reinvested in education, mental health services and other areas to help further reduce incarceration rates.
    • HB 2472 (Sen. Treat, Rep. Peterson): Gives prosecutors discretion to file non-85 percent crimes as misdemeanors instead of felonies, while considering the age, background, criminal history, character and rehabilitation needs of the offender.
    • HB 2479 (Sen. Treat, Rep. Peterson): Reduces the minimum mandatory punishment for drug offenders charged only with possession, and removes the possibility of a life sentence for the simple possession of drugs.
    • HB 2751 (Sen. Treat, Rep. Peterson): Increases the threshold for felony property crimes from $500 to $1,000. It was last increased in 2002.
    • HB 2753 (Sen. Shaw, Rep. Peterson): Establishes means for broader use of drug courts and community sentencing by allowing participation, when appropriate, by those who are not yet convicted of a felony.
  • SB 1491 (Sen. Marlatt, Rep. Biggs):  “Kristin’s Law” - enables tougher penalties for domestic violence (DV) to be handed down sooner
  • SB 1214 (Sen. Sharp, Rep. Wood):  modifies the not guilty by reason of insanity defense in Oklahoma by adding a guilty but with mental defect and not guilty by reason of mental illness defense; ensures those convicted will have to complete the sentence for their crime.
  • SB 1113 (Sen. Holt, Rep. Grau): reforms civil asset forfeiture laws by allowing recovery of attorney fees by those who have unjustly had their assets seized through the civil asset forfeiture process.
  • SB 1057 (Sen. Fry, Rep. Calvey):  compromise legislation between chambers/gun rights group; broadens gun rights in parks, recreational areas and fairgrounds except during the period when a number of events are taking place. The legislation also provides significant protection for gun owners, event hosts and employers who allow employees to carry guns.
  • SB 1257 (Sen. Holt, Rep. Jordan):  criminalizes “revenge porn” by outlawing the unauthorized dissemination of intimate photos or video — usually after a relationship has ended — an act commonly referred to as “revenge porn.”
  • HB 3146 (Sen. Treat, Rep. Sanders):  makes Oklahoma drivers safer by closing a loophole that allowed repeat drunk drivers to get multiple DUI convictions in various jurisdictions without being held accountable.
  • HB 2398 (Sen. Griffin, Rep. Biggs):  closes a loophole in Oklahoma’s sodomy law that arose after an Oklahoma Court of Criminal Appeals ruling
  • HB 2275 (Sen. Jolley, Rep. Denney): allows DNA samples to be collected upon arrest for a felony crime, enabling law enforcement to solve crimes as well as cold cases for some of those most heinous crimes in our state
  • HB 2443 (Sen. Shaw, Rep. O’Donnell):  provides 24 months instead of 12 months for a prisoner to ask for a modification of his or her sentence.
  • HB 2474 (Sen. Griffin, Rep. Peterson):  allows limited driving privileges for offenders re-entering the community, increasing the likelihood of success and productivity of those individuals.
  • HB 3039 (Sen. Shaw, Rep. Jordan): allows inmates to cut their jail sentence by one day for each eight-hour shift they work for the local government or a private employer.
  • HB 3119 (Sen. Shaw, Rep. Martin): allows drug court judges to reduce or waive all costs upon completion of all drug court program requirements.
  • HB 2934 (Sen. Sykes, Rep. McCullough): Permits a district attorney to dismiss an action or indictment prior to the commencement of the preliminary hearing, prior to being set for trial.
  • HB 3159 (Sen. Griffin, Speaker Hickman): any offender serving an “85 percent” sentence would be subject to a parole hearing upon completing 85 percent of their sentence.
  • HB 3160 (Sen. Griffin, Speaker Hickman):  reduces court costs and fees while a person serves time in prison and allow judges to waive them in certain circumstances.
  • HB 2425 (Sen. Griffin, Rep. Kern):  increases child prostitution age limitation, engaging in prostitution with any individual under the age of 18 is a felony with accordingly higher penalties.
  • HB 2397 (Sen. Sykes, Rep. Dunlap):  modifies expungement of certain minor offenses, making it easier for Oklahomans who have been convicted of a minor misdemeanor offense speed up the process to have the criminal and civil record expunged.
  • HB 2555 (Sen. Sykes, Rep. Wright): clarifies statutory language related to penalties for driving under the influence and modifies conditions for subsequent offenses.
  • HB 2599 (Sen. Sharp, Rep. Wood):  measure that restricts flight of unmanned aircraft over “critical infrastructure” less than 400 feet above ground level or past their fence lines.
  • HB 2747 (Sen. Loveless, Rep. Morrissette):  creates “Blue Alerts” to notify the public, media and law enforcement agencies statewide when a law enforcement office is killed or injured and the suspects have fled the scene.
  • HB 3024 (Sen. Holt, Rep. Jordan):  outlaws so-called “catfishing,” anyone who uses another person's photos or video to carry out a so-called catfishing scam may be held liable for monetary damages.
