2014 Session Overview

The 2014 Oklahoma Legislative Session convened on February 3, 2014, and adjourned sine die on May 23, 2014, a week earlier than required in the Oklahoma Constitution.  The officers of the Senate for 2013 were continued, including Senator Brian Bingman, President Pro Tempore, Senator Mike Schulz, Majority Floor Leader and Senator Sean Burrage, Democratic Floor Leader.  The Legislature considered 2,399 bills and joint resolutions, of which 188 Senate measures and 213 House measures became law.  Governor Mary Fallin vetoed 35 measures and two of those vetoes were overridden by the Legislature.  Another two measures referred three state questions to the voters for action at the November 2014 election.

The Legislature also met in September of 2013 in an extraordinary session for the purpose of considering legislation relating to HB 1603 which was enacted by the Legislature in 2009, and which related to tort reform.  The Legislature considered 43 measures, of which 23 were enacted and approved by the Governor.

At the end of the 2014 session, the Senate said goodbye to four Senators who are ineligible to run for re-election due to term limits:  Senators Cliff Aldridge, Cliff Branan, Harry Coates and Jerry Ellis; and to six others who chose not to seek re-election:  Senators Roger Ballenger, Sean Burrage, Tom Ivester, Constance Johnson, Rob Johnson and Al McAffrey.

With respect to specific issues, general appropriations for state government for fiscal year 2015 were included in SB 2127, including protection of or increases in funding for common education, drug courts, the Health Care Authority, the Pinnacle Plan administered by the Department of Human Services and the ROADS fund.  The Legislature also passed targeted salary increases for correctional officers, state troopers and designated state employees, comprehensive public pension system reform, an income tax rate reduction, an incentive for oil and gas drilling, and funding to repair the State Capitol.

Other Senate leadership agenda items passed in 2014 include:

Jobs/Economy

  • HB2509- Mazzei (Signed by Governor) – Extends the sunset date of the aerospace engineer tax credit to January 1, 2018.
  • SB1246- Bingman (Signed by Governor)- Takes top income tax rate to 5% and 4.85%, subject to revenue triggers.
  • HB2956 – Sharp (Signed by Governor) – Removes the population qualifier in the Small Employer Quality Jobs Incentive Act.  Small businesses in large metropolitan areas may now qualify for the incentive.
  • HB2562 – R. Johnson (Signed by Governor) – Sets the incentive for horizontal and vertical drilling at 2% for 36 months and then the tax increases to 7%.  Sunsets various drilling incentives in 2015 while extending others to 2020.

Education

  • SB1655- Ford (Signed by Governor) -Removes requirement to assess school districts in the A-F grading system.
  • HB3399- Brecheen (Signed by Governor) – Repeals Common Core State Standards. Directs the State Department of Education to implement new standards tat are deemed “college and career ready” within 3 years.
  • SB2127 – Jolley (Signed by Governor) – Appropriates an additional $105 million to common education.
  • HB2625- Stanislawski (Veto Overriden) – Modifies the Reading Sufficiency Act.  Students are given multiple opportunities throughout the year to demonstrate reading sufficiency in the 3rd grade.  Students scoring limited knowledge on 3rd grade criterion-referenced test are eligible to be promoted with an intensive remediation program.  Students who are deficient may still be granted probationary promotion to the 4th grade per the decision of a Student Reading Proficiency Team consisting of parents, educators, and school administration. 

Health and Human Services

  • SB2127- Jolley (Signed by Governor) – Appropriates an additional $47 million in FY14 to reduce provider rate cuts at the Health Care Authority.
  • SB2127- Jolley (Signed by Governor) – Increases appropriation to the Department of Mental Health and Substance Abuse Services for drug courts, Systems of Care and pay raises.

Public Safety

  • SB232- Jolley (Signed by Governor) – Authorizes a pay increase for state troopers.
  • SB1278- David (Signed by Governor) - Creates Pay for Success Contract Revolving Fund. Allows for OMES to contract with a private entity for delivery of criminal justice outcomes.
  • SB1364 – Griffin (Signed by Governor) -Creates a zone of safety around city parks to protect against sex offenders.
  • SB1421- Loveless (Signed by Governor) – Prohibits a person required to register as a sex offender from petitioning for a change of name.
  • SB1431- Newberry (Signed by Governor)- Applies provisions of the Sex Offenders Registration Act to those who coerce someone into human trafficking.
  • SB1433- Newberry (Signed by Governor) - Adds human trafficking to the list of 85% crimes.
  • SB1444- Holt (Signed by Governor) – Requires sex offenders to be photographed by local law enforcement.
  • SB1538- Dahm (Signed by Governor) - Defines victim in relation to human trafficking. Allows victims to bring action in district court and extends statute of limitations.
  • SB2046 – Griffin (Signed by Governor) – Increases penalties on repeat domestic violence offenders.
  • HB3016 – Griffin (Signed by Governor) - Requires a person subject to the Oklahoma Sex Offender Registration Act to register with local law enforcement in the jurisdiction the offender resides or intends to reside for 7 consecutive days or 14 days in a 60 day period.

Veterans

  • SB1610 – Simpson (Signed by Governor) – Expands eligibility for access to state veterans centers to all veterans, not just those who served during wartime.
  • SB1970- Simpson (Signed by Governor) - Reconstitutes the OK War Veterans Commission as the Veterans Commission. Modifies requirements for board members. Members shall serve at the pleasure of the governor.

Transportation

  • SB2127 – Jolley (Signed by Governor) – Adds approximately $60 million to the ROADS Fund.

Government Reform

  • HB2630- Brinkley (Signed by Governor) – Requires OPERS to establish a defined contribution system for employees first employed on or after November 1, 2015. Employees vest in 5 years.

Other Bills of Note:

  • SB1848 – Treat (Signed by Governor) - Requires the State Board of Health to establish supply and equipment standards for abortion facilities. Requires adoption of standards for personnel who work in such facilities. Requires standards for performance of the procedure and follow-up. Requires physicians to have admitting privileges at an accredited hospital within 30 miles of where the procedure takes place.
  • SB2127- Jolley (Signed by Governor) – Appropriates approximately $45 million in additional funds to the Department of Human Services to fund the Pinnacle Plan.
  • SB2131- Jolley (Signed by Governor) – Provides for 12,378 employees at 25 agencies to receive raises ranging from 5% to 13.5%, with most raises based upon the 2013 state employee compensation study.
  • HB2685 – Stanislawski (Signed by Governor) - Prohibits an abortion from being performed or induced without voluntary and informed consent at least 24 hours before the procedure. Places requirements on procedures that must be performed to be considered consent. State Board of Medical Licensure and Supervision must publish materials regarding available perinatal hospice and palliative care within ninety days after the passage of the act.
  • HJR1033 – Bingman (Signed by Governor) – Authorizes a $120M bond issue for repair and renovation of the State Capitol.
