OVERVIEW OF 2012 SESSION

 

The 2012 Oklahoma Legislative Session convened on February 6 and adjourned sine die on May 25, 2012, under the leadership of Senator Brian Bingman, President Pro Tempore, Senator Mike Schulz, Majority Floor Leader and Senator Sean Burrage, Democratic Floor Leader.  The Legislature considered over 2,000 bills and joint resolutions, of which 171 Senate measures and 221 House measures became law.  Governor Mary Fallin vetoed 11 measures.  Four state questions were referred to the people for a vote in November, along with two which were referred in 2011 (for more information, see Legislative Brief at http://www.oksenate.gov/publications.aspx). 

 

General appropriations for state government for fiscal year 2013 were included in SB 1975, including funding for National Board Certification bonuses, bridge and road funding, water monitoring, increased services mandated by a lawsuit settlement involving the Department of Human Services, the Justice Reinvestment Initiative and Highway Patrol trooper academies.  Supplemental funding for fiscal year 2012 for health benefits for education personnel, National Board Certification bonuses, Highway Patrol trooper academies, the Office of the Chief Medical Examiner and the State Emergency Fund was provided in SB 1959.

 

In the 2011 interim, the Senate accepted the resignations of long-time Senators Jim Reynolds and Andrew Rice, and mourned the loss of the late Senator David Myers.  In their places, the Senate welcomed three new members:  Senators Greg Childers, Al McAffrey and A.J. Griffin.  Due to redistricting, Senator Childers will serve out the remainder of the unexpired term but will not return for the 2013 session.  The Senate thanked seven other members who will not be returning:  Senators Tom Adelson, Judy Eason McIntyre, Charlie Laster, Richard Lerblance, Jonathan Nichols, Steve Russell and Jim Wilson.

 

Senate leadership agenda items passed in 2012 include:

 

Job Creation and Economic Development

·         SJR52 (Sen. Mike Mazzei and Rep. David Dank) – Sends to a vote of the people a constitutional amendment change which would exempt intangible property from taxation. (Passed Senate and House; headed to statewide ballot).

·         HCR1031 (Sen. Ron Justice and Rep. John Enns) – Calls for Congressional oversight of the Environmental Protection Agency due to rules and regulations passed by that agency which hinders businesses and makes it more expensive for them to operate. (Approved).

·         HB2204 (Sen. Dan Newberry and Rep. Randy McDaniel) – Requires individuals to register for work on OESC website after applying for unemployment benefits.  Claimant has burden of proof when there is a positive drug or alcohol test.  25% penalty for fraud related to overpayment of unemployment benefits.  Increases efficiency in the unemployment claim process. ·         SB1246 (Sen. Brian Bingman and Rep. Fred Jordan) – Puts a stay on payment of workers’ compensation benefits when a person if going through a workers’ compensation fraud proceeding. (Signed by the Governor).

 

Education

·         SB1959 (Sen. Clark Jolley and Rep. Earl Sears) – Provides supplemental funding for flexible benefits and National Board Certification bonuses. (Signed by the Governor).

·         SB1975 (Sen. Clark Jolley and Rep. Earl Sears) – Appropriates funds to various state agencies, including funding for National Board Certification bonuses for FY13. (Signed by the Governor).

·         SB1816 (Sen. Gary Stanislawski and Rep. Marty Quinn) – Allows the State Board of Education to sponsor a statewide virtual charter school. (Signed by the Governor).

·         SB1056 (Sen. Frank Simpson and Rep. Pat Ownbey) – Establishes a pilot program at technology center school districts to increase the number of students taking industry certification examinations and obtaining trade-specific industry certifications and licenses. (Signed by the Governor).

·         SB1863 (Sen. Steve Russell and Rep. Ann Coody) – Allows colleges and universities to utilize courses and experience gained by honorably discharged service members as an exchange for college credit. (Signed by the Governor).

 

Health and Human Services

·         HB3133 (Sen. Greg Treat and Rep. Mike Sanders) – Provides that any individual who knowingly provides false information in a deprived child proceeding commits a felony. (Signed by the Governor).

·         HB3134 (Sen. Greg Treat and Rep. Kris Steele) – DHS to eliminate the Field Operations Division and to vertically integrate all program divisions and staff; field operations and programs shall no longer be separated into different divisions. (Signed by the Governor).

·         HB3135 (Sen. Greg Treat and Rep. Kris Steele) – Allows for DHS to release certain information when a child death has occurred. (Signed by the Governor).

·         HB3137 (Sen. Greg Treat and Rep. Kris Steele) – Gives the Governor authority to select the DHS Director, subject to confirmation from the Senate. Creates citizen advisory panels to evaluate core areas of DHS. (Signed by the Governor).

·         HJR1092 (Sen. Greg Treat and Rep. Kris Steele) – Refers to the vote of the people a constitutional amendment which would delete the DHS Commission and allow the department to be administered under the Governor’s purview. (Passed Senate and House; headed to statewide ballot).

·         HB3058 (Sen. Brian Bingman and Rep. Kris Steele) – Establishes a rural residency training program to be administered through the OK Healthcare Authority. (Signed by the Governor).


Public Safety

·         SB1734 (Sen. Anthony Sykes and Rep. Fred Jordan) – Allows any peace officer to conduct investigations and make arrests in regard to human trafficking violations.  (Signed by the Governor)

·         SB1959 (Sen. Clark Jolley and Rep. Earl Sears) – Provides supplemental funding for an additional OHP trooper academy. (Signed by the Governor).

·         SB1975 (Sen. Clark Jolley and Rep. Earl Sears) – Provided funding for the Justice Reinvestment Initiative, which includes block grants for police departments, mental health counseling, and monitoring upon a person’s release from prison. Also annualized supplemental funding for OHP trooper academies. (Signed by the Governor).

·         HB2941 (Sen. Rick Brinkley and Rep. David Derby) – Requires pharmacies to maintain electronic records of non-prescription pseudoephedrine sales.  Institutes real-time tracking service in Oklahoma and across state lines.  A stop-sale order will be issued if certain conditions are met. Reforming Oklahoma Government

·         SB1096 (Sen. Brian Bingman and Rep. Scott Martin) – Energy efficiency initiative for all state buildings. Estimated savings over 10 years of $300M to $500M. (Signed by the Governor).

·         SB1975 (Sen. Clark Jolley and Rep. Earl Sears) – Budget passed this year kept most agencies at a standstill budget.  Major increases were limited to DHS due to the settlement agreement and Dept. of Transportation to restore funding to the 8-year plan. (Signed by the Governor).

·         HB3055 (Sen. Eddie Fields and Rep. Kris Steele) – Establishes public policy of Oklahoma that the state will consume no more fresh water in 2060 than is consumed in 2012.  (Signed by the Governor).

·         SB1975 (Sen. Clark Jolley and Rep. Earl Sears) – Allocates $2M for water monitoring as called for in the Comprehensive Water Plan. (Signed by the Governor).

·         HB2262 (Sen. Clark Jolley and Rep. T.W. Shannon) – Establishes the Maintenance of State Buildings Revolving Fund. Proceeds from the sale of excess state property shall be deposited into the fund. (Signed by the Governor).


Transportation and Infrastructure Improvement

·         SB1975 (Sen. Clark Jolley and Rep. Earl Sears) – Returns the ROADS Plan to full funding. (Signed by the Governor).

·         HB2248 (Sen. Bryce Marlatt and Rep. T.W. Shannon) – Raises the cap on the ROADS Fund by $140M for a total of $575M. (Signed by the Governor).

·         HB2249 (Sen. Bryce Marlatt and Rep. T.W. Shannon) – Raises the apportionment of motor vehicle taxes going to the county road and bridges fund over a 3-year period for a total of $20M. (Signed by the Governor).
